Nobody knows what will be the decision of the California Supreme Court regarding Proposition 8. It came as a shock when in May 2008 the court ruled that the 2000 state law banning gay marriage was discriminatory so this time nobody knows what to expect.
According to City Attorney Dennis Herrera, anything is possible. In May 2008 he was actually stunned by the court’s decision as he came prepared for the exact opposite situation. With all this background surrounding the court, we just might be heading for another surprise.
However, the bet has been placed on the court ruling with the voters who passed the constitutional ban in November. Attorney General Jerry Brown thinks that even if this happens the court will continue to recognize the 18,000 gay marriages that happened before the vote.
This will surely cause an awkward situation, as Prop 8 denies the right of same sex marriage although 18,000 couples are living a happy, married life.
UPDATE : The California Supreme Court upheld Proposition 8.
